Workplace Investigation Skills - October 2018

Very often workplace allegations regarding bullying, discrimination and misconduct or employee grievances involve a complex set of circumstances/facts and it is necessary to conduct an impartial investigation to establish whether the allegations can be substantiated or not.

This course will equip participants with the practical skills to undertake a fair and impartial investigation, grounded on the principles of natural justice.

Participants will be able to assess the evidence gathered and draw a conclusion on the balance of probabilities that will be sound and defensible.

Course Content:
  • What is an investigation
  • The investigator
  • Terms of reference (the scope of the project)
  • Natural justice and procedural fairness
  • Planning the investigation or information gathering
  • Personal dynamics of an investigation
  • Direct vs. hearsay evidence
  • Interview techniques and taking a statement
  • Other evidence that may need to be collected
  • Assessing the evidence
  • Writing the report
  • Avoiding common investigation pitfalls

At the end of this training session, participants will be able to:

  • Understand the context that requires an investigation
  • Understand the role of the investigator
  • Identify the scope of the investigation
  • Appreciate the need for natural justice and procedural fairness
  • Plan an investigation
  • Take meaningful witness statements
  • Understand and utilise various interviewing techniques
  • Assess evidence and determine a finding on a balance of probabilities
  • Understand what needs to be included in a report
